These Terms of Use ("Terms") govern your access to and use of the website operated by Forward Forensics ("Forward Forensics", "we", "us" or "our"), including all content, features and services made available through it (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Acceptance of These Terms
By browsing the Site, submitting an enquiry, subscribing to our newsletter or registering for a training course, you confirm that you have read, understood and agree to these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
2. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date at the top of this page shows when the Terms were last changed. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
3. Use of the Website
You may use the Site only for lawful purposes and in accordance with these Terms. The Site and its content are intended for business and professional audiences, including law enforcement, government and corporate organisations evaluating or engaging Forward Forensics' services. You are responsible for ensuring that your use of the Site complies with the laws applicable to you.
4. Intellectual Property Rights
Unless otherwise stated, all content on the Site — including text, graphics, logos, the Forward Forensics name and mark, product names (such as Forward Forensics™ products), images and software — is owned by or licensed to Forward Forensics and is protected by copyright, trademark and other intellectual property laws.
You may view, download and print content from the Site for your own personal or internal business use, provided you keep all copyright and other proprietary notices intact. You may not reproduce, distribute, modify, create derivative works from, publicly display or commercially exploit any part of the Site without our prior written consent.
Forward Forensics Shield® is a registered trade mark of Forward Forensics, registered with the Intellectual Property Office (IPO) of the United Kingdom and protected under the Trade Marks Act 1994 and equivalent legislation in other jurisdictions. The Forward Forensics Shield name, mark and associated product names may not be used in connection with any goods, services or promotional materials without the prior written authorisation of Forward Forensics. Unauthorised use — including reproduction, imitation, association or passing-off — constitutes trade mark infringement and may expose the infringing party to civil liability, injunctive relief, an account of profits and damages. All goodwill arising from any authorised use of the Forward Forensics Shield mark accrues exclusively to Forward Forensics.
5. Prohibited Conduct
When using the Site, you agree not to:
- Violate any applicable law or regulation;
- Infringe the intellectual property, privacy or other rights of any person;
- Upload or transmit viruses, malware or other harmful code;
- Attempt to gain unauthorised access to the Site, our systems or any related network;
- Use any automated means (such as bots or scrapers) to access the Site, except for standard search engine indexing;
- Interfere with or disrupt the operation of the Site; or
- Submit false, misleading or fraudulent information through any form on the Site.
6. Training Courses & Bookings
The Site allows you to register interest in, or book a place on, Forward Forensics training courses. Submitting a booking or registration of interest is a request to attend, and does not guarantee a place until confirmed by Forward Forensics. Course dates, locations, formats, fees, seat availability and content described on the Site are indicative and may change; we will notify you of any material change affecting a confirmed booking. Specific payment, cancellation and rescheduling terms for a given course will be confirmed separately at the time of booking.
7. Nature of Services Described
Descriptions of Forward Forensics' forensic investigation services, laboratory solutions, signal isolation solutions, forensic workstations and evidence management systems on the Site are provided for general informational purposes to help you evaluate our capabilities. They do not constitute an offer capable of acceptance, a quotation, or professional, investigative or legal advice. Any actual engagement, purchase or delivery of services is governed exclusively by a separately negotiated and signed service agreement, statement of work, purchase order or similar contract between you and Forward Forensics, the terms of which will prevail over anything described on the Site in the event of a conflict.
8. Third-Party Links
The Site may link to third-party websites for your convenience. We do not control, endorse or take responsibility for the content, accuracy or practices of any third-party site, and you access them at your own risk.
9. Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including (to the extent permitted by law) warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Forward Forensics shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or related to your use of, or inability to use, the Site, even if advised of the possibility of such damages. Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law, including the UK GDPR, the Data Protection Act 2018 or other mandatory consumer or data protection rules.
11. Indemnification
You agree to indemnify and hold Forward Forensics, its officers, employees and agents harmless from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless a separate service agreement between you and Forward Forensics specifies otherwise.
13. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any applicable service agreement, constitute the entire agreement between you and Forward Forensics regarding use of the Site, and supersede any prior agreements relating to the same subject matter. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
